1. About this Policy
This Privacy Policy explains how FARQ collects, uses, discloses, and protects your personal information when you visit www.farqthebrand.com (the “Site”), purchase our products, subscribe to our service, or otherwise interact with us.
“Personal information” means information about an identifiable individual. It includes information such as your name, shipping and billing address, email address, phone number, and order history. It does not include information that has been aggregated or anonymized so that it can no longer be associated with you.
We are responsible for the personal information in our control. This Policy is drafted to reflect our obligations under Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, provincial privacy laws.
2. What we collect and why
We collect personal information that you provide directly and information collected automatically when you use the Site.
Information you give us, for example when you:
- Create an account, place an order, or manage your subscription (name, shipping/billing address, email, phone, order and subscription details).
- Pay for an order (payment is processed by our platform provider as described in Section 4 we do not store full card numbers).
- Sign up for our newsletter, SMS updates, or promotions.
- Contact us, request a return or refund, or respond to a survey.
Information collected automatically when you browse the Site, such as your device and browser type, IP address, pages viewed, and how you interact with the Site, collected through cookies and similar technologies (see Section 8).
We use personal information to:
- Process and fulfill your orders and manage your subscription, including recurring billing, renewals, cancellations, and returns.
- Provide customer support and respond to your inquiries.
- Send you transactional messages (order confirmations, shipping updates, renewal notices).
- With your consent, send you marketing communications by email and/or SMS.
- Operate, secure, analyze, and improve the Site and our products.
- Detect and prevent fraud and comply with our legal obligations.
We will not use your personal information for a materially different purpose without your consent, unless permitted or required by law.
3. Consent
By providing us with your personal information to complete a transaction, verify your payment method, place an order, or arrange delivery or a return, you consent to our collecting and using it for that specific purpose.
If we ask for your personal information for a secondary purpose, such as marketing, we will either ask you directly for your express consent or give you the opportunity to decline. You may withdraw your consent at any time (subject to legal or contractual restrictions and reasonable notice) by contacting us at legal@farqthebrand.com. Withdrawing consent may limit our ability to provide certain services to you.
4. Service providers and disclosure
We share personal information with third-party service providers only to the extent needed for them to perform services for us. Our principal providers include:
- Shopify Inc.: our e-commerce platform and payment processor. Shopify stores order, account, and subscription data and processes payments in accordance with the Payment Card Industry Data Security Standard (PCI-DSS). - Klaviyo: email and SMS marketing and customer messaging.
- Google Analytics: Site analytics and usage measurement.
- Meta (Facebook/Instagram) and TikTok: advertising and measurement (see Sections 8 and 9).
These providers may store or process personal information outside of Canada, including in the United States. When personal information is located in another jurisdiction, it is subject to the laws of that jurisdiction, and may be accessible to that country’s courts, law enforcement, and national-security authorities. By using the Site, you acknowledge this transfer and processing.
We may also disclose personal information: (a) if required or permitted by law, or in response to a valid legal request (b) to protect our rights, property, or safety, or that of others or (c) in connection with a merger, acquisition, financing, or sale of assets, in which case your information may be transferred to the successor entity, subject to this Policy.
We do not sell your personal information.
5. Retention
We retain personal information only as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, tax, and reporting requirements, and to resolve disputes and enforce our agreements. When personal information is no longer needed, we take reasonable steps to securely destroy, delete, or anonymize it. We may retain information for a longer period where there is a complaint or a reasonable prospect of litigation.
6. Safeguards
We take reasonable technical, administrative, and physical measures to protect personal information against loss, theft, and unauthorized access, use, or disclosure. Payment information is encrypted in transit using industry-standard technology. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Your rights
Subject to applicable law, you have the right to:
- Access the personal information we hold about you.
- Request correction of inaccurate or incomplete information.
- Withdraw consent to our use of your information (as described in Section 3).
- Unsubscribe from marketing communications at any time (see Section 10).

We may take reasonable steps to verify your identity before responding, and we will respond within the timeframes required by applicable law. Access and correction rights are subject to legal exceptions.
8. Cookies and similar technologies
We use cookies and similar technologies to operate the Site, remember your preferences and cart, measure traffic, and support marketing. Categories include:
- Strictly necessary / functional: enable core functions such as your cart, secure checkout, and account login.
- Analytics: help us understand how the Site is used (e.g., Google Analytics).
- Advertising: support and measure advertising (e.g., Meta and TikTok pixels see Section 9).
You can set your browser to refuse some or all cookies, or to alert you when cookies are set. Disabling cookies may cause parts of the Site to stop working properly. Where required by law, we will obtain your consent before using non-essential cookies and provide a means to manage your preferences.
9. Advertising and analytics
We work with third parties, including Meta and TikTok, to deliver and measure advertising across their platforms and the web. These parties may use cookies, pixels, and device identifiers to collect information about your activity on the Site and elsewhere. As part of these campaigns, we or these platforms may match information such as a hashed email address or phone number to your account on those platforms so we can show you relevant ads.
You can manage or opt out of interest-based advertising through your account settings on the relevant platform, your device or browser settings, and tools such as the Digital Advertising Alliance of Canada’s opt-out page (https://youradchoices.ca/en/tools).
10. Marketing communications (CASL)
With your consent, we send commercial electronic messages by email and/or SMS in accordance with Canada’s Anti-Spam Legislation (CASL). Every marketing message includes an unsubscribe mechanism, and we will honour opt-out requests promptly. For SMS, you can also reply STOP to cancel and HELP for help message and data rates may apply, and message frequency varies. Opting out of marketing does not affect transactional messages related to your orders or subscription.
11. Age of majority
The Site and our products are intended for adults. By using the Site, you represent that you are the age of majority in your province of residence. We do not knowingly collect personal information from children.
12. Changes and contact
We may update this Policy from time to time. Material changes will be posted on this page with a revised “Last updated” date and, where required, we will notify you. Your continued use of the Site after changes take effect constitutes acceptance of the updated Policy.
